Please read these Terms & Conditions carefully before accessing, browsing, registering on, or using the Magicine Pharma website, mobile application, or any related digital platform. By accessing or using the Platform, you agree to be bound by these Terms & Conditions and all policies incorporated by reference. If you do not agree, please do not use the Platform.
1. ABOUT MAGICINE PHARMA
The domain name [www.magicinepharma.com], the mobile application Magicine Pharma, and any associated digital platform, portal, microsite, or related interface are owned, operated, and managed by Magicine Pharma Private Limited, a company incorporated under the Companies Act, 2013, having its registered office atC-107, 2B 2nd Floor, Ambulance Building, Naraina Industrial Area Phase 1, New Delhi-110028, with CIN: U46497DL2023PTC423999, GSTIN :AARCM5876C, and PAN : AARCM5876C.
For the purposes of these Terms & Conditions, “Magicine Pharma”, “Company”, “we”, “us”, and “our” shall mean Magicine Pharma Private Limited, and “you”, “your”, and “User” shall mean any person who accesses, browses, registers on, purchases from, books services through, uploads information to, or otherwise uses the Platform.
The website, application, and all associated digital touchpoints are collectively referred to as the “Platform.”
2. ACCEPTANCE OF TERMS
2.1 By accessing, browsing, registering on, transacting on, or using the Platform in any manner, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.
2.2 These Terms & Conditions constitute a legal and binding agreement between you and Magicine Pharma.
2.3 Your use of the Platform is also subject to our Privacy Policy, Return, Refund, Cancellation and Shipping Policy, Prescription Policy, if applicable, Grievance Redressal Policy, and any additional terms, notices, disclaimers, or policies published on the Platform from time to time.
2.4 If you navigate to a third-party website or service through a link on our Platform, your use of that external website or service will be governed by that third party’s own terms and policies.
3. SCOPE OF SERVICES
3.1 Magicine Pharma is a digital platform that may facilitate one or more of the following services:
a. online sale of pharmaceutical products, prescription medicines, over-the-counter products, wellness products, nutraceuticals, healthcare devices, and related products by the Company and/or licensed third-party sellers or pharmacies;
b. prescription order processing and fulfilment, subject to applicable law;
c. diagnostic and pathology test booking through third-party laboratories or diagnostic centres;
d. online doctor consultation, teleconsultation, second opinion, or healthcare support services through independent registered medical practitioners or partner healthcare providers;
e. disease-awareness, health education, product information, medicine information, and wellness-related content;
f. order processing, payment collection support, logistics coordination, delivery support, customer care, and grievance handling; and
g. such other lawful services as may be made available on the Platform from time to time.
3.2 All such offerings are collectively referred to as the “Services.”
3.3 Magicine Pharma may operate as a direct seller for certain products or services, an inventory-based e-commerce entity for certain products, a marketplace or facilitator for certain third-party services, or a hybrid of the above, depending on the nature of the product or service involved.
4. ELIGIBILITY
4.1 You must be legally competent to contract under applicable Indian law to use the Platform.
4.2 By using the Platform, you represent and warrant that you are at least 18 years of age; or if you are acting for a minor, dependent, or patient, you are their lawful parent, guardian, caregiver, or otherwise authorized representative.
4.3 You further represent that you have the legal authority to accept these Terms & Conditions, all information provided by you is accurate, current, and complete, and your use of the Platform will comply with all applicable laws.
4.4 Magicine Pharma reserves the right to deny access to, suspend, or terminate any account or service if it reasonably believes that a person is not eligible to use the Platform.
5. USER REGISTRATION AND ACCOUNT
5.1 To access certain Services, you may be required to register and create an account on the Platform.
5.2 During registration, we may collect details including, but not limited to: name, mobile number, email address, password, billing address, shipping address, age or date of birth, gender where relevant, payment-related details, prescription and health-related details where applicable, and any other information necessary for lawful service delivery.
5.3 You agree that:
a. you will provide true, accurate, current, and complete information;
b. you will maintain and update your account details promptly;
c. you will maintain confidentiality of your login credentials;
d. you will not share your account with another person without lawful authority;
e. you will be solely responsible for all activities conducted through your account;
f. you will immediately notify us of any suspected unauthorized access or security breach.
5.4 Magicine Pharma may suspend, restrict, or terminate your account if any information provided by you is false, misleading, incomplete, outdated, suspicious, or unlawful.
6. PRESCRIPTION MEDICINES
6.1 Certain medicines or products listed on the Platform may be sold only against a valid prescription issued by a registered medical practitioner, in accordance with applicable law.
6.2 By placing an order for any prescription-only medicine, you agree that: you will upload, submit, or share a genuine and valid prescription in the format required by us; the prescription must relate to the patient for whom the medicine is being ordered; the medicine ordered must correspond to the prescription; the order is subject to pharmacist review, validation, and lawful permissibility; and the order may be rejected, modified, held, or cancelled if the prescription is invalid, incomplete, expired, altered, suspicious, or non-compliant.
6.3 Magicine Pharma reserves the right to request the original prescription, additional documentation, identity confirmation, or doctor verification where considered necessary.
6.4 Where required by law or internal compliance protocols, the Company may maintain records of prescriptions, order logs, communication trails, and associated compliance documentation.
6.5 No prescription medicine will be dispensed or facilitated in violation of applicable law.
6.6 Any substitution of prescribed medicines, if at all permitted, shall be subject to applicable law, pharmacist review, prescription wording, and the lawful availability of suitable substitutes.
7. NATURE OF LISTINGS, INVITATION TO OFFER, AND ORDER ACCEPTANCE
7.1 The listing of any product or service on the Platform shall be treated as an invitation to offer and not as a binding offer for sale.
7.2 When you place an order, you are making an offer to purchase the selected product or service.
7.3 A confirmation of receipt of order, payment acknowledgment, or order number generation does not by itself constitute final acceptance of your order.
7.4 An order shall be deemed accepted only when payment is successfully processed, where applicable; the product or service is verified as available; prescription review is completed, where applicable; compliance checks are cleared; and the order is approved for fulfilment.
7.5 Magicine Pharma reserves the right to reject, cancel, or hold any order for reasons including, without limitation: stock unavailability, invalid prescription, legal or regulatory concerns, pricing or technical error, delivery serviceability limitations, suspected fraud, misuse of offers or coupons, or other operational or compliance reasons.
8. PRODUCTS, CONTENT, AND INFORMATION
8.1 The Platform may display product descriptions, pricing, pack details, indications, ingredients, usage instructions, benefits, warnings, images, FAQs, blogs, educational articles, health awareness content, videos, and other material.
8.2 Such content is provided on an informational basis only, unless explicitly stated otherwise.
8.3 Health content, medicine information, and educational material on the Platform do not constitute medical advice, do not create a doctor-patient relationship, are not a substitute for diagnosis, treatment, or professional medical consultation, and should not be relied upon for emergencies.
8.4 Product photographs and packaging visuals may sometimes vary from actual packaging due to manufacturer updates, display settings, or technical reasons.
8.5 Magicine Pharma makes reasonable efforts to keep information current, but does not guarantee that every listing, description, image, or specification will always be fully complete, error-free, or up to date.
9. DOCTOR CONSULTATION, SECOND OPINION, AND HEALTHCARE SERVICES
9.1 Where the Platform enables online consultation, second opinion, or doctor-connect services, such services are provided by independent registered medical practitioners and/or partner healthcare providers.
9.2 Magicine Pharma acts primarily as a technology, coordination, scheduling, support, or facilitation platform unless expressly stated otherwise.
9.3 By using such Services, you acknowledge and agree that:
a. online medical interaction is not a substitute for emergency medical care;
b. in some cases, physical examination may be necessary and online consultation may not be sufficient;
c. the advice or opinion given depends materially on the accuracy and completeness of the information provided by you;
d. a doctor may refuse consultation, defer opinion, ask for more records, or advise an in-person visit; and
e. medical outcomes cannot be guaranteed.
9.4 Nothing on the Platform shall be construed as creating a direct doctor-patient relationship with Magicine Pharma itself merely because the Platform facilitates access to such services.
9.5 Teleconsultation and online consultation services, where offered, are intended to function in a manner broadly consistent with applicable Indian telemedicine and medical professional conduct requirements.
10. DIAGNOSTIC AND LAB SERVICES
10.1 The Platform may facilitate booking of diagnostic tests, pathology tests, sample collection, and related services through third-party laboratories or diagnostic centres.
10.2 In such cases, Magicine Pharma may act as an aggregator, intermediary, or facilitator.
10.3 The actual collection of samples, conduct of tests, quality of testing, generation of reports, and interpretation of results are the responsibility of the concerned laboratory or diagnostic service provider.
10.4 Magicine Pharma does not independently conduct laboratory testing unless expressly stated on the Platform.
10.5 Test availability, sample collection slots, rescheduling, cancellation, home collection timelines, and reporting timelines may vary based on the concerned provider and operational conditions.
11. PRICING, PAYMENT, TAXES, AND BILLING
11.1 All prices displayed on the Platform are subject to change without notice unless otherwise required by law.
11.2 Prices may include or exclude taxes, delivery charges, handling charges, convenience fees, or discounts, as indicated at checkout or on the applicable order page.
11.3 You agree to pay all charges applicable to your order or booking.
11.4 Payments may be processed through third-party payment gateways, banks, UPI service providers, wallet providers, card processors, or other payment facilitators.
11.5 Magicine Pharma shall not be liable for any loss caused by payment gateway downtime, bank failures, failed or delayed payment authorization, unauthorized transactions outside our control, or technical failures of third-party payment systems.
11.6 You agree that invoices, bills, order summaries, or transaction confirmations may be generated electronically.
12. DELIVERY AND LOGISTICS
12.1 Delivery timelines shown on the Platform are indicative only.
12.2 Actual delivery may be affected by prescription verification, product availability, geography, local regulations, delivery partner limitations, weather conditions, strikes, public holidays, or force majeure events.
12.3 You agree to provide accurate delivery details and to be available to accept delivery where required.
12.4 Delivery of certain medicines may require additional checks, identity confirmation, or compliance steps.
12.5 Magicine Pharma reserves the right to refuse or delay delivery if legal or safety requirements are not met.
13. RETURNS, REFUNDS, CANCELLATIONS, AND REPLACEMENTS
13.1 Returns, refunds, cancellations, and replacements shall be governed by the separate Return, Refund, Cancellation and Shipping Policy published on the Platform.
13.2 Certain products may be non-returnable or non-refundable, including but not limited to prescription medicines, temperature-sensitive products, opened, damaged, or used items, hygiene-sensitive products, and products restricted by law or compliance rules.
13.3 Refunds, where applicable, shall be processed in accordance with our policy, payment method rules, and applicable law.
13.4 Magicine Pharma reserves the right to verify return claims, product condition, shipment records, and customer details before approving any refund or replacement request.
14. PRIVACY, DATA PROCESSING, AND CONSENT
14.1 Your use of the Platform is subject to our Privacy Policy.
14.2 By using the Platform, you acknowledge and agree that Magicine Pharma may collect, process, store, retain, disclose, and otherwise handle your personal data, including health-related information where relevant, for purposes including registration, identity verification, order fulfilment, prescription validation, customer support, diagnostic and consultation coordination, compliance and audit, fraud prevention, service improvement, analytics, and legally permitted communications.
14.3 Magicine Pharma intends to handle personal data in a manner consistent with applicable Indian law, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and applicable rules thereunder.
14.4 You are responsible for ensuring that data, records, prescriptions, and information uploaded by you are accurate and lawfully shared.
14.5 Where required by law, consent-based processing, notices, withdrawal mechanisms, and grievance channels shall be handled in accordance with our Privacy Policy and internal compliance procedures.
15. COOKIES, ANALYTICS, AND PLATFORM TECHNOLOGIES
15.1 The Platform may use cookies, software development kits, tracking technologies, log files, pixels, and similar tools for authentication, fraud prevention, performance optimization, analytics, user preferences, and service enhancement.
15.2 By continuing to use the Platform, you consent to such use to the extent permitted by applicable law and our Privacy Policy.
16. PROMOTIONS, OFFERS, AND DISCOUNT PROGRAMS
16.1 Magicine Pharma may, from time to time, offer discounts, coupons, loyalty credits, cashback, wallet credits, promotional codes, bundled offers, referral benefits, or campaign-specific benefits.
16.2 Such offers are subject to specific terms, validity periods, redemption conditions, exclusions, and anti-misuse checks.
16.3 Magicine Pharma reserves the right to withdraw, modify, suspend, or cancel any promotional scheme at any time without prior notice, subject to applicable law.
16.4 In cases of abuse, fraud, duplicate account use, or misuse of offers, Magicine Pharma may cancel the order, reverse the benefit, or suspend the account.
17. ADVERTISEMENTS AND SPONSORED CONTENT
17.1 The Platform may contain advertisements, sponsored listings, promotional material, or marketing communications relating to products, services, or healthcare-related offerings.
17.2 Such content may be clearly labelled as sponsored, promoted, advertisement, partner content, or by similar identifiers, where appropriate.
17.3 Magicine Pharma reserves the right to accept, reject, edit, remove, or restrict advertising content at its sole discretion.
17.4 No advertisement, sponsored content, or promotional communication on the Platform shall be interpreted as medical advice, a guaranteed treatment outcome, or a substitute for lawful diagnosis and prescription.
17.5 Drug- and remedy-related advertising, health claims, cure claims, and promotional language used on or through the Platform are intended to be governed by applicable Indian law, including the Drugs and Cosmetics framework and the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954.
18. USER CONDUCT AND RESTRICTIONS
18.1 You agree not to use the Platform to: a. upload false, forged, manipulated, expired, or invalid prescriptions; b. impersonate another person or entity; c. submit false, misleading, or incomplete information; d. engage in unlawful, abusive, harmful, fraudulent, deceptive, defamatory, obscene, harassing, or discriminatory conduct; e. interfere with the security, integrity, or operation of the Platform; f. upload malware, viruses, or malicious code; g. scrape, crawl, reverse engineer, decompile, copy, or reproduce the Platform or its content without authorization; h. use bots, scripts, or automated means to access or manipulate the Platform; i. violate any healthcare, pharmacy, consumer, privacy, advertising, intellectual property, or other applicable laws; or j. use the Platform in any way that harms Magicine Pharma, other users, service providers, or the public.
18.2 Magicine Pharma may investigate suspected violations and may remove content, reject transactions, suspend accounts, or report conduct to authorities where appropriate.
19. THIRD-PARTY SERVICES AND LINKS
19.1 The Platform may integrate with or link to third-party websites, laboratories, doctors, pharmacies, payment service providers, delivery partners, communication platforms, or information sources.
19.2 Magicine Pharma does not control such third-party services and does not warrant or guarantee their content, conduct, availability, or performance.
19.3 Your dealings with third parties are at your own risk, subject to their own terms and conditions.
20. INTELLECTUAL PROPERTY
20.1 All rights, title, and interest in and to the Platform, including its design, layout, branding, source code, software, databases, graphics, text, logos, trademarks, service marks, interfaces, compilations, and original content, are owned by or licensed to Magicine Pharma unless otherwise stated.
20.2 You are granted a limited, non-exclusive, non-transferable, revocable right to access and use the Platform solely for personal and lawful purposes.
20.3 You shall not, without prior written permission, copy, reproduce, modify, distribute, republish, display, transmit, commercially exploit, or create derivative works from any part of the Platform.
21. DISCLAIMERS
21.1 The Platform and all Services are provided on an “as is” and “as available” basis.
21.2 To the maximum extent permitted by law, Magicine Pharma disclaims all warranties, express or implied, including warranties relating to merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, uninterrupted access, or error-free performance.
21.3 Magicine Pharma does not guarantee that the Platform will always be available, that any product will always be in stock, that any consultation will result in a diagnosis or prescription, that any health content is sufficient for your specific condition, or that any third-party service will meet your expectations.
21.4 In the event of a medical emergency, you should immediately contact a qualified doctor, hospital, or emergency service provider and not rely on the Platform.
22. LIMITATION OF LIABILITY
22.1 To the fullest extent permitted by law, Magicine Pharma, its affiliates, directors, officers, employees, licensors, consultants, service providers, agents, and partners shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages arising out of or in connection with your use or inability to use the Platform, delayed or failed order fulfilment, prescription rejection or compliance holds, doctor consultation outcomes, lab report issues, third-party acts or omissions, payment failures outside our control, loss of data, revenue, goodwill, or opportunity, or reliance on information available on the Platform.
22.2 Without prejudice to the above, to the extent legally permissible, Magicine Pharma’s aggregate liability in relation to any claim arising from the Platform or Services shall not exceed the amount actually paid by you to Magicine Pharma for the specific transaction giving rise to the claim, or INR 1,000, whichever is lower, except where a higher liability is mandatorily required under applicable law.
23. INDEMNITY
23.1 You agree to defend, indemnify, and hold harmless Magicine Pharma and its affiliates, directors, officers, employees, consultants, licensors, agents, and service providers from and against any claim, action, loss, liability, penalty, damage, cost, or expense, including reasonable legal fees, arising out of or related to your breach of these Terms & Conditions, your violation of law, your misuse of the Platform, your submission of false or unlawful information, your infringement of any third-party rights, or your acts or omissions in connection with the Platform.
24. SUSPENSION AND TERMINATION
24.1 Magicine Pharma may suspend, restrict, deactivate, or terminate your access to the Platform or any Service, temporarily or permanently, with or without prior notice, if you breach these Terms & Conditions or any policy, we suspect fraud, abuse, misuse, or unlawful conduct, required documents or verifications are not provided, your account cannot be authenticated, required consent is withdrawn, continued service becomes operationally, legally, or commercially impracticable, or we are required to do so by law, court order, or regulatory authority.
24.2 Upon termination, your right to use the Platform shall immediately cease.
24.3 Magicine Pharma may retain or delete your information in accordance with applicable law, internal retention requirements, audit obligations, tax requirements, pharmacy compliance, and dispute-related necessity.
25. FORCE MAJEURE
25.1 Magicine Pharma shall not be liable for any delay, interruption, deficiency, or failure in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, floods, epidemics, pandemics, cyberattacks, war, riots, civil disturbances, labour disruptions, internet outages, power failures, government actions, transportation breakdowns, or failure of third-party infrastructure.
26. GOVERNING LAW AND DISPUTE RESOLUTION
26.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of India.
26.2 Subject to applicable law, the courts at New Delhi shall have exclusive jurisdiction over disputes arising from or relating to these Terms & Conditions and/or use of the Platform.
26.3 Magicine Pharma may also elect, where appropriate, to refer disputes to arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed in accordance with applicable law, with the seat and venue at [FILL IN CITY] and proceedings in English.
27. COMPLIANCE WITH LAW
27.1 Users shall use the Platform in compliance with all applicable laws, rules, and regulations.
27.2 These Terms & Conditions are intended to operate in a manner consistent with applicable Indian legal requirements, including consumer protection, e-commerce, pharmacy, drugs and cosmetics, advertising restrictions, data protection, and relevant technology law obligations.
27.3 Nothing in these Terms & Conditions shall be construed as permitting any act prohibited by law.
28. MODIFICATIONS TO THE PLATFORM OR TERMS
28.1 Magicine Pharma reserves the right to modify, suspend, discontinue, update, or replace all or any part of the Platform or Services at any time.
28.2 Magicine Pharma may also revise these Terms & Conditions from time to time.
28.3 Updated Terms & Conditions shall become effective upon publication on the Platform unless stated otherwise.
28.4 Your continued use of the Platform after such publication shall constitute acceptance of the revised Terms & Conditions.
29. SEVERABILITY
If any provision of these Terms & Conditions is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
30. WAIVER
No waiver by Magicine Pharma of any breach or default under these Terms & Conditions shall be deemed a waiver of any preceding or subsequent breach or default.
31. SURVIVAL
Any provisions which by their nature should survive termination or expiry of these Terms & Conditions shall survive, including provisions relating to intellectual property, indemnity, limitation of liability, dispute resolution, data retention, compliance, and disclaimers.

33. ACCOUNT DELETION
33.1 You may request deletion of your account by contacting Magicine Pharma through the support channels specified on the Platform.
33.2 Account deletion may be irreversible.
33.3 Even after account deletion, Magicine Pharma may retain certain records where necessary for legal compliance, tax and audit requirements, prescription retention, fraud prevention, dispute resolution, internal security, or regulatory obligations.
34. ENTIRE AGREEMENT
These Terms & Conditions, together with the Privacy Policy and all other applicable policies published on the Platform, constitute the entire agreement between you and Magicine Pharma in relation to your use of the Platform and supersede any prior understandings relating to the same subject matter.
